DESCRIPTION OF OCCURRENCE:
On 4/5/17 a verbal and physical altercation occurred between two male patients. Patient (A) is in his 60's and patient (B) is in his 30's.
The facility conducted an internal investigation and notified the police. Both patients were admitted as incompetent to proceed related to criminal charges. Patient (A) was facing charges related to 2nd degree assault of a peace officer, harassment and theft and has diagnoses of dementia unspecified, alcohol use disorder and indications of delusional disorder and opioid use disorder. Patient (A) has a history of verbal and physical aggression. Patient (B) was facing charges related to sexual contact and harassment and has diagnoses of neurocognitive disorder due to traumatic brain injury, unspecified depressive disorder, opioid use disorder and antisocial personality traits. Patient (B) has a history of behaviors that tend to provoke peers. A staff member observed patient (B) tipping over patient (A) in his wheelchair. Staff immediately separated the patients. Patient (B) reported that he was walking past patient (A) when patient (A) grabbed his arm, called him a profane name, punched his arm and threated to kill him. Patient (B) responded by tipping over the wheelchair that patient (A) was in. Patient (A) admitted to calling patient (B) names and hitting him on the arm. Both patients were assessed for injuries. Patient (B) did not sustain any injuries. Patient (A) sustained a cut under the fingernail on his right thumb and complained of bilateral shoulder pain and low back pain. Patient (A)'s laceration was treated, ibuprofen was administered for pain and neurological checks were initiated. Both patients were placed on a peer restriction from each other and on assault precautions. Patient (B) was asked to walk to his room and refused. Patient (B) began to fight security staff when they attempted to escort him and was contained and placed in seclusion and restraint. Patient (B) was released from seclusion and restraint and was moved to different wing of the facility away from patient (A).
The Department reviewed the facility's report and supplemental documentation and found that the facility acted appropriately by reporting the occurrence, notifying the appropriate persons/agencies and conducting an investigation. The summary findings were based on facility information provided to the department at the time of review.
The Department will review this occurrence prior to the next survey.
