DESCRIPTION OF OCCURRENCE:
On 3/25/17 male patient (B), in his 20s, alleged he had been touched inappropriately by male patient (A), who was in his 60s.
The facility conducted an internal investigation and notified the police and physician. Patient (B) told staff patient (A) had grabbed his buttocks with both hands while they were in the men's bathroom. Patient (B) stated he was washing his hands when this occurred and he was fully dressed. Patient (A) denied the allegation. Staff separated the patients. Nursing assessed patient (B) and he denied having any injuries. Patient (A) did have a history of engaging in sexually inappropriate behaviors. There were no other witnesses to the alleged event and patient (B) reported he was not fearful of patient (A). A peer restriction was implemented for both patients and patient (A) was placed on Assault I precautions. Both patients agreed to stay away from one another. Staff would continue monitoring the patients to re-direct and intervene if necessary.
The Department reviewed the facility's report and supplemental documentation and found that the facility acted appropriately by reporting the occurrence, notifying the appropriate persons/agencies and conducting an investigation. The summary findings were based on facility information provided to the department at the time of review.
The Department will review this occurrence prior to the next survey.
