DESCRIPTION OF OCCURRENCE:
On 10/12/16 male patient (A), in his 20's, reported he witnessed male patient (B), in his 30's, slap and pinch the buttocks of male patient (C), who was in his 20's. Patient (A) reported the event occurred on 10/11/16.

FACILITY ACTION:
The facility conducted an internal investigation and notified the police. Patient (B) was diagnosed with schizophrenia and polysubstance abuse. He was identified as confused and disoriented. While incarcerated, he had a history of exposing himself to staff and other inmates and was known to stand naked in his cell. Patient (C) was diagnosed with schizoaffective disorder (bipolar type) and polysubstance use in forced remission. He was identified as disorganized and influenced by delusional thoughts. While at the facility, he had two incidents of sexually inappropriate conversations/comments. Patient (A) reported he witnessed patient (B) "slapping and pinching" patient (C)'s buttocks on 10/11/16. Patient (C) was in the shower and was naked when the alleged event occurred. Staff spoke to patient (C) and asked him if anyone on the unit was bothering him. Patient (C) stated patient (B) slapped his butt, noting, "I told him to stop." Patient (C) confirmed the contact was not consensual, but denied fearing patient (B). Patient (C) denied injury and declined assessment. Patient (B) was interviewed and admitted to the event. However, he minimized his behavior, stating he was just "playing grab ass." Patient (B) was placed on a peer restriction from all male patients and was closely monitored by staff. Patient (B) was also placed on assault precautions.

DEPARTMENT FINDINGS:
The Department reviewed the facility's report and supplemental documentation and found that the facility acted appropriately by reporting the occurrence, notifying the appropriate persons and agencies, and conducting an investigation. The summary findings were based on facility information provided to the Department at the time of review.

The Department will review this occurrence prior to the next survey.
