DESCRIPTION OF OCCURRENCE:
On 06/16/16 male patient (B), who was in his 40s, alleged another male patient (A) inappropriately touched him. Patient (A) was in his 20s.
The facility conducted an internal investigation and notified the physician and police. It was reported patient (A) walked over to patient (B), reached out and touched patient (B) on the thigh. Staff redirected patient (A) away and instructed him not to touch other patients. Patient (A) then urinated on a glass window and became aggressive when staff attempted to re-direct him again. Patient (A) was contained, placed in restraints and escorted to the seclusion room. Later, patient (B) reported patient (A) had actually touched his penis over his clothes. The staff member reported she did not witness patient (A) grabbing patient (B)'s crotch, but only observed patient (A) touching patient (B) on the thigh. Patient (B) did not wish to press charges against patient (A). Facility staff reported patient (B) has a history of making false allegations, but patient (A) had a history of inappropriate sexual behaviors. Staff continued to monitor both patients and assault II precautions were implemented.
The Department reviewed the facility's report and supplemental documentation and found that the facility acted appropriately by reporting the occurrence, notifying the appropriate persons/agencies and conducting an investigation.
The Department will review this occurrence prior to the next survey.
