DESCRIPTION OF OCCURRENCE:
On 03/22/16 female patient (A), in her 30s, reported female patient (B), in her 20s, touched her inappropriately.
The facility conducted an internal investigation and notified the police department. Patient (A) gave staff a note indicating patient (B) had touched her buttocks, twice. Patient (A) stated she told patient (B) not to touch her but patient (B) continued to do so. Patient (A) also added that another patient had witnessed the incident, however, that patient denied seeing anything. Patient (B) was placed on peer restriction from patient (A) and the other patient. The three patients were housed on separate wings of the unit. Patient (B) did not have a history of sexually inappropriate behaviors. Staff on the unit and the psychologist reported patient (B) touching another patient inappropriately would be totally out of character for this patient and believed the allegation was false. Patient (B) denied the allegation. The facility was not able to substantiate the allegation.
The Department reviewed the facility's report and supplemental documentation and found that the facility acted appropriately by reporting the occurrence, notifying the appropriate persons/agencies and conducting an investigation.
The Department will review this occurrence prior to the next survey.
