DESCRIPTION OF OCCURRENCE:
On 11/20/15 female patient (A), in her 60s, reported male patient (B), also in his 60s, touched her inappropriately.
The facility conducted an internal investigation. The facility notified the physician and the police department. Patient (A) yelled out that patient (B) had touched her breasts. Staff intervened and separated the patients. Patient (B) admitted to inappropriately touching patient (A). He was escorted to his room away from the victim. Patient (B) had a history of sexual acting out behaviors. Patient (A) was assessed and no visible injury noted. Patient (A) was interviewed by police and stated she did not want to press charges. She was not fearful of the male patient. Patient (B) was placed on peer restriction and one-to-one monitoring.
The Department reviewed the facility's report and supplemental documentation and found that the facility acted appropriately by reporting the occurrence, notifying the appropriate persons and agencies, conducting an investigation, separating the patients, assessing patient (A), interviewing patients and staff, placing patient (B) on peer restriction and placing patient (B) on one-to-one monitoring by staff.
The Department will review this occurrence prior to any survey or upon receipt of any complaint that may be filed against this facility.
