DESCRIPTION OF OCCURRENCE:
On 10/31/15 a male patient, in his 30s, alleged he was touched inappropriately by a staff member.

FACILITY ACTION:
The facility conducted an internal investigation. The facility notified security. The patient reported a staff member tapped him on the buttocks three times to wake him. Another staff member was present and witnessed the interaction. The resident denied any injuries or being fearful, i or upset regarding this incident. He stated it just surprised him and he thought it was wrong. The patient stated the nurse should not have touched him and she was not professional. Later the patient reported he was moving on and was "over it." Staff reported no changes in the resident's behaviors. The accused staff member was suspended pending the investigation. Another staff member, present during this interaction, stated the accused staff member attempted to wake the patient up for a medical assessment by patting him on the buttocks five times and grabbing his buttocks. The patient was sleeping. The accused staff member stated she was trying to wake the patient in order to perform a medical assessment. She stated she reached out and tapped him twice on the upper leg, not the buttocks. She denied that she intentionally tapped him in an inappropriate manner. The facility concluded the allegation of sexual abuse did not occur but the staff member should have followed policies related to personal boundaries. The accused staff member resigned.

DEPARTMENT FINDINGS:
The Department reviewed the facility's report and supplemental documentation and found that the facility acted appropriately by reporting the occurrence, notifying the appropriate persons and agencies, suspending the staff member, conducting an internal investigation and accepting the staff member's resignation.

The Department will review this occurrence prior to any survey or upon receipt of any complaint that may be filed against this facility.
