DESCRIPTION OF OCCURRENCE:
On 08/21/15 a male patient, in his 30s, inappropriately touched a female patient, who was in her 30s.
The facility conducted an internal investigation. The facility notified the hospital police and administrative personnel. As the patients were lined up at the door, the male patient reached out and put his hand on the female's buttocks. Staff separated the patients. The female stated she did not consent to the inappropriate touching. She denied feeling fearful. Both patients were placed on peer restrictions. These two patients were housed on separate wings on the unit. There were no reported injuries. The male received a program fine for inappropriate touching. No further incidents have occurred.
The Department reviewed the facility's report and found that the facility acted appropriately by reporting the occurrence, notifying the appropriate persons and agencies, separating the patients, implementing peer restrictions and giving him a program fine.
The facility was subject to a deficiency for failure to report the occurrence timely. The Department will review this occurrence prior to any survey or upon receipt of any complaint that may be filed against this facility.
