DESCRIPTION OF OCCURRENCE:
On 05/28/15 a female adolescent patient alleged she had been sexually assaulted by a staff member.
The facility conducted an internal investigation. The facility notified the police department and appropriate facility administration and personnel. The patient reported she had been sexually assaulted by a staff member about three months ago on three separate occasions. The patient was assessed and there were no injuries noted. The patient expressed fear of the staff member. The staff member was removed from all patient contact. Interviews revealed the patient had divulged the incidents to two peers and a staff member. One of the peers stated they thought the patient was imagining things and delusional. The staff member reported the patient had always requested his assistance with problems on the unit. The patient had made a previous allegation about another peer which required a peer restriction. The facility was unable to substantiate the allegation. The staff member returned to work, however, was temporarily reassigned to a different unit until a permanent placement is determined. The staff member will no longer work in the same unit as the patient.
The Department reviewed the facility's report and supplemental documentation and found that the facility acted appropriately by reporting the occurrence, notifying the appropriate persons and agencies, assessing the patient, removing the staff member from patient care, conducting an investigation, and re-assigning the staff member to another unit until a permanent placement is determined.
The Department will review this occurrence prior to any survey or upon receipt of any complaint that may be filed against this facility.
