DESCRIPTION OF OCCURRENCE:
On 02/06/15 a female patient, in her 30s, reported a male patient made inappropriate remarks to her and was physically aggressive toward her. The male patient was in his 40s.
The facility conducted an internal investigation and notified the police and physician. The female stated she and the male patient had been in the kitchen cooking. The female asked the male what was on his pizza and he grabbed her pants pocket and put her in a head lock to get her to take a closer look at the pizza. She said he spoke in a gruff manner and she felt intimidated by him. The male patient was interviewed and denied that his behavior was threatening and he said that he did not intend to intimidate the female. The male was moved to another building. The female said that she and the male had a joking relationship with one another and that she had difficulty setting boundaries. The female did not want to press charges. Both patients were given consequences since they had been observed touching each other (in a non-sexual manner) at times. In addition, staff spoke to the female about her clothing choices which are provocative at times.
The Department reviewed the facility's report and supplemental documentation and found that the facility acted appropriately by reporting the occurrence, notifying the appropriate persons and agency, assessing the female, moving the male to another unit, conducting an investigation and giving consequences to both patients.
The Department will review this occurrence prior to any survey or upon receipt of any complaint that may be filed against this facility.
