DESCRIPTION OF OCCURRENCE:
On 02/06/15 male patient (B), in his 20s. allegedly made sexual advances towards female patient (A), who was in her 20s.
The facility conducted an internal investigation. The facility notified the police, deputy directors of the program and the superintendent. Patient (A) claimed patient (B) made sexual advances and had attempted to pull her pants down on two occasions without her consent. Patient (A) was assessed and had no injuries. The patients were placed on silent reflections (peer restrictions) from each other and safety observations were implemented. Patient (B) was placed on peer restriction from all female patients. Patient (A) declined to press charges. Resident (B) denied the allegations. The facility was unable to substantiate the allegation.
The Department reviewed the facility's report and supplemental documentation and found that the facility acted appropriately by reporting the occurrence, notifying the appropriate persons and agencies, conducting an internal investigation, assessing the resident, separating the residents and monitoring the residents.
No deficient practice was cited. The Department will review this occurrence prior to any survey or upon receipt of any complaint that may be filed against this facility.
