DESCRIPTION OF OCCURRENCE:
On 11/12/14 male patient (A), in his 50s, alleged he had been inappropriately touched by male patient (B). Patient (B) was in his late teens.

FACILITY ACTION:
The facility conducted an internal investigation. The facility notified police and the physician. Patient (A) said the assault happened in the day room and reported that patient (B) had touched his penis. Patient (A) changed his story many times and during his initial interview had identified a different patient as the assailant. The facility was unable to substantiate the allegation. The patients reside on different wings of the facility. Staff monitored both patients

DEPARTMENT FINDINGS:
The Department reviewed the facility's report and supplemental documentation and found that the facility acted appropriately by reporting the occurrence, notifying the appropriate persons and agencies, conducting an investigation and monitoring both patients.

No deficient practice was cited. The Department will review this occurrence prior to any survey or upon receipt of any complaint that may be filed against this facility.
